These Terms of Use (the “Terms”) set forth the conditions for use of the website “harks.jp” and the various products, landing pages, demos, early-access offerings, and consultation services planned, developed, and operated by Harks Inc. (the “Company,” “we,” or “us”) (collectively, the “Services”). By using the Services, you are deemed to have agreed to these Terms.
1. Scope
These Terms apply to all relationships between the Company and users arising from use of the Services. If separate terms of use, notices, disclaimers, or other specific conditions are established for an individual product or service, those specific conditions take precedence over these Terms.
2. Description of the Services
The Services include consultation support concerning AI product development and PoC validation, as well as introduction pages, demos, early-access registrations, and prototype services under validation for products planned and developed by the Company. Many products are in a validation stage (early access / PoC), and their features, scope of availability, and availability period may be changed, expanded, or discontinued without prior notice.
3. Use of the Services
Some parts of the Services require you to submit an inquiry form or demo request form. Please provide accurate information. For products that provide account registration, you are responsible for managing IDs, passwords, and similar credentials in accordance with the information provided for the relevant product. If a minor uses the Services, the Services must be used with the consent of a parent, guardian, or other appropriate legal representative.
4. Prohibited Conduct
When using the Services, you must not engage in any of the following:
- Conduct that violates laws or regulations or public order and morals.
- Conduct that infringes the intellectual property rights, publicity or portrait rights, privacy, or other rights of the Company or a third party.
- Impersonating the Company or a third party, or entering false information.
- Placing an excessive load on the servers or networks of the Services, or bypassing system safeguards through unauthorized access, reverse engineering, or similar acts.
- Using information obtained through the Services for purposes outside the intended purpose or providing it to a third party without authorization.
- Other conduct that the Company determines to be inappropriate for the operation of the Services.
5. AI-Generated Output and User-Submitted Content
Certain products may handle AI-generated output or content posted or entered by users. The Company does not guarantee the accuracy or legality of such content or that it does not infringe third-party rights. Users are responsible for the final review and determination concerning such content.
6. Changes, Suspension, and Discontinuation of the Services
The Company may change, add to, suspend, or discontinue all or part of the Services without prior notice to users. The Company is not liable for damage arising from such actions beyond the extent permitted by applicable law.
7. Disclaimers
The Company makes no express or implied warranty that the Services are free from defects in fact or in law, including defects relating to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, or security. To the extent permitted by applicable law, the Company is not liable for damage incurred by users arising from the Services, except where the damage results from the Company’s willful misconduct or gross negligence.
8. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Japan. Any dispute between the Company and a user arising in connection with the Services is subject to the exclusive agreed jurisdiction of the Tokyo District Court as the court of first instance.

10. Changes to These Terms
